Terms of Service

The agreement between you and ShotsDesk when you use the platform.

These Terms govern your use of ShotsDesk ("Service"). By creating an account you agree to them. If you are using ShotsDesk on behalf of a business, you confirm you are authorized to bind that business.

1. The service

ShotsDesk is a SaaS platform for photography studios — galleries, bookings, invoicing, lead capture and related workflows. Features evolve over time.

2. Your account

  • You must be 18+ to create a studio account.
  • Keep your credentials confidential. You are responsible for activity under your account.
  • One person per account; team members get their own seats.

3. Acceptable use

  • No illegal content, no infringement of third-party rights, no malware.
  • No automated scraping, abuse of the API, or attempts to circumvent quotas.
  • You are responsible for obtaining consent from people whose data you upload (clients, models).

4. Your content

You retain ownership of all content you upload (photos, client data, documents). You grant ShotsDesk a limited license to store, process and display that content solely to operate the Service for you.

5. Plans, payment and trials

  • Paid plans renew automatically until cancelled. Manage billing in Settings → Billing.
  • Trials convert to paid at the end of the trial unless you cancel.
  • Prices are exclusive of VAT unless stated. We may change prices with 30 days notice.
  • Refunds are at our discretion. Statutory consumer rights are not affected.

6. Storage limits

Each plan includes a storage allowance. Uploads are blocked when the allowance is exceeded. You can purchase add-on storage in Billing.

7. Suspension and termination

  • You can cancel any time. Your data remains accessible until the end of the paid period and is then deleted within 30 days unless legally required otherwise.
  • We may suspend or terminate accounts that violate these Terms, abuse the Service, or fail to pay.

8. Service levels and availability

We aim for high availability but do not guarantee uninterrupted service. The Service is provided "as is". Planned maintenance is announced in advance when feasible.

9. Liability

To the maximum extent permitted by law, our total liability for any claim is limited to the fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, including lost profits or lost data beyond the most recent backup.

10. Privacy and data processing

Personal data is handled in line with our Privacy Policy. For studios processing client data through ShotsDesk, our Data Processing Agreement applies and is incorporated by reference.

11. Changes

We may update these Terms. Material changes are announced by email at least 30 days before they take effect. Continued use after that date means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the Netherlands. Disputes are subject to the exclusive jurisdiction of the courts of Amsterdam, without prejudice to any mandatory consumer protection rules of your country of residence.
